Legal career is very wide and a little complicated too. To select the right legal career is always a worrisome factor for a law graduate. To shape up a legal career takes a little longer time than any other profession because experience plays a very vital role in it. People would hesitate to take risk going to a new lawyer where there are lots of experienced people available. So, it is advisable for a new law graduate to get licensed to practice and work under a leading lawyer before starting practice on his own. Most of the lawyers specialize in one area of law and they stick to it. So, first of all, you have decided to pursue your career in one area of law, try to get a chance to work under an expert for a while, learn things practically and start your own practice. This would give more confidence to you clients to entrust their cases to you without an element of doubt.

injury lawyer are involved in the cases which deals in injury related issues and litigation. Injury litigation includes road accidents, medical malpractices, product liability, work place injuries and death etc. In this particular injury law itself, Injury lawyers will try to focus on a particular segment wherein he/ she can be an adept and handle such cases more tactfully.

As in any other area of legal practice, an injury lawyer can also start his legal practice solo, or with some of his/her partners or as an associate with some of the leading law firms. Once an injury lawyer gains enough practice, She/he is free to start solo practicing where they can offer more personal attention to the clients. There will be more chances of developing a one to one relationship with his/her clients. A solo practitioner can attend to even a small injury case at a lower fee structure. Normally, a small law firm will have maximum 10 injury lawyer who can give more expertise in the area of injury law. A mid-sized firm will have 30-50 lawyers. They offer their services in almost all areas of litigation with more focus on injury cases engaging their experienced injury lawyers.

Remuneration of Injury Lawyers

You cannot gauge the fee structure of injury lawyers just like that because it depends on factors such as time, energy, effort, the outcome of a case, experience, expertise and prominence of an injury lawyer and of course the nature of that particular case. The fee can be paid in different modes such as hourly, flat rates and contingency rates. Contingency fee is a pre- fixed rate on the percentage of compensation the client receives out of the litigation. The advantage to client in this case is that he/she is not liable to pay the fee unless the case is won. Most of the injury lawyers work on this method. In hourly fee structure, the injury lawyer gets the fee for the time he/she spend on a case until it resolved. In some cases injury lawyers are paid at a flat rate which could be a set amount or a retainer where in a certain amount is paid before the legal trial begins.

Injury Lawyers are controlled by the code of conduct set by the Bar Association of state. It is vested with the powers to take action against the injury lawyers who violate the professional ethics. In the US, Injury lawyers can be a member of Association of Personal Injury Lawyers.

Generally, if your legal problem is serious (misdemeanor or felony) and/or involves a lot of money, you might not want to risk handling the matter without the legal counsel of an attorneys. Attorneys do more than just give you legal advice, he or she will be able to offer strategic advice and apply sophisticated technical skills to your legal problems. If you are facing large fines or jail time, it’s time to find the right attorneys.

Finding the right Attorney, someone who takes a personal passion in pursuing your best interests, takes more than sifting through the phone book or looking through newspaper or online advertisements. If you talk to several people who have had similar legal problems, chances are they will provide you with a few good leads. That doesn’t mean you should choose your attorneys solely by the merit of someone’s recommendation. Consumer’s dissatisfaction with lawyers have been rising, with some studies showing up to one-third of consumers feeling dissatisfied.

The following are some good tips for finding the right attorneys for you.

1. Consider a specialist. Almost every attorneys specializes in certain areas that pique their interest. There are over one million lawyers in America today, so finding the right one is just a matter of looking hard enough.

2. Interview the prospective Attorney. When you have compiled a list of prospects, the next step is to meet each one face-to-face. Generally, you will be able to schedule a half-hour appointment at no charge so that you can size them up.

3. Pay attention to personality. Your attorneys, no matter how experienced they are, is someone you have to feel comfortable with in order to reach an ideal attorneys-client relationship. Pick attorneys whose personality is compatible with yours.

4. Ease of communication and promptness. Ask your prospective attorneys how you will be able to contact them and how long it will take them to return your calls. Don’t assume your attorneys will be prompt because of his personality.

5. Willingness to work with you. When you have a legal problem, you need legal information. Attorneys are a prime source of this information, but if you bought all the information you needed at their rates, $150-$300/hour, most people would go bankrupt. So make sure your attorneys is willing to work with you, at a reasonable rate, to provide the help you need.

6. Finally, choose attorneys you know you can afford. Discuss flat-rate or hourly rate billing. Your attorneys should be able to provide you with a rough estimate on both types of charges. Avoid the embarrassment, and harassment, that comes with not being able to pay your bills.

There are several things you can do in the following days and weeks after an accident to protect your right to compensation should you choose to file an injury claim. Except for filing a formal claim against a government entity, none of the proceedings actually require the counsel of attorneys. However, the following suggestions may make your claim process a little smoother.

1. Write down as much as you can about the accident itself, your injuries and losses that have resulted from the accident.

2. Take notes on the conversation that you had with the people involved in the accident. Be detailed, note the time of day, weather, and the people who were involved. Include every detail of what you saw and felt, twists, blows, and shocks to your body.

3. Preserve evidence of the person at fault in the accident and the damage done. Collect physical evidence and take photographs if you can.

4. Locate people who witnessed the accident and might be able to help prove your case.

5. Notify anyone you think might be responsible for the accident of your intention to file a claim for your injuries.

6. Take note of the Statue of Limitations in your respective state and attempt to file your claim before your opportunity expires.

Injury claims don’t have to involve attorneys. Especially with basic accident claims, a little patience and organization will be enough to get you through the process. Unless you think your insurance company is unfairly denying or reducing your compensation, you can wind up with considerably more compensation simply from forgoing the fee for retaining attorneys.

The following, however, are a few instances in which the assistance of attorneys is recommended.

1. Sometimes, you simply need the threat of an experienced personal injury attorneys to nudge the insurance company towards the ‘right’ decision.

2. Long-term and permanently disabling injuries are another instance in which attorneys can help figure out the most you can get out of your claim.

3. Medical malpractice. If you have suffered at the hands of a careless, unprofessional, or incompetent doctor, nurse, clinic, or hospital, the medical questions and legal rules involved are extremely complex. This would almost certainly require that you retain attorneys experienced in personal injury and medical malpractice.

4. When an insurance company refuses to pay. In some instances, an insurance company or government agency will simply refuse to make any fair settlement offer. In these cases, something, minus what the attorneys will charge, is better than absolutely nothing.

5. Toxic exposure. In an increasingly chemical world, we can become ill from exposure to contaminants in air, soil, water, and even in food products. Claims based on such exposure are difficult to prove, often because of a lack of complex scientific data, and because chemical and other industries are all but absolutely protected from legal exposure pertaining to such instances. Experienced attorneys will know about any ongoing class-action suits or other similar cases and will be able to provide invaluable advice.

As many of you are aware of, there are several different types of attorneys that one can choose to become. Some deal with criminal cases, some with divorces, bankruptcy, and the list goes on. Different people choose what branch of law they are going to practice for different reasons. Some attorneys have personal reasons for why they chose their particular branch, some attorneys find the work interesting, but there are always people out there that choose their position based on money. For those of you out there with your eyes out for the green, here is a list of the top paid attorneys.

1. Plaintiff attorneys – These are the lawyers that represent plaintiffs during class action lawsuits or personal injury. Since many of these lawsuits end with the plaintiff being paid exorbitant amounts of money, their attorneys usually get a big piece of the pie. Many of these lawyers agree to take a case pro bono both to build up their reputations and because they can afford it.

2. Corporate attorneys – Large corporations have a lot of money to burn and the best lawyers know that. This is why they charge high rates to corporations, and the companies are willing to pay those amounts because they need a competent lawyer to represent them in court. From what we have seen from corporations in the last few years, they are going to need as much first class legal help as they can get.

3. Tobacco attorneys – When you are representing the distributors of one of the most lethal products in existence, you better make sure you are getting paid a hell of a lot to do so. Tobacco companies make their billions of dollars by feeding off of people’s addictions, all while deteriorating their customers’ health in the process. This leads to a whole lot of legal trouble, so they need top notch lawyers to bail them out. Some might argue that there is somewhat of a moral issue here, but if all you are looking for is dollar signs, you probably won’t have a problem with a little immorality.

4. Divorce attorneys – We’re not talking about any type of divorce lawyer here, the top paid divorce lawyers take the wheel when there is a ton of money that is being disputed over. Celebrities, socialites, and top executives call these guys when their marriages dissolve so they can get a bigger chunk of money, and of course their lawyers will be rewarded handsomely for their services. Shelling out some extra money for a decent lawyer could be worth it, being stingy might lose you your house, cars, and dogs if you don’t get the right person for the job.

All of you aspiring attorneys out there, choose one of these if you want to make the big bucks. Just try to remember when you are rolling in pies of cash, money is not everything.

The majority of United States Presidents were attorneys at one point in their careers. For the most part, people trust attorneys to uphold the law and fight for justice, so which makes it easier for people to trust attorneys when they make a run for the White House. It helps when there is documented cases available to view that show how much good the attorneys have done for the average citizen. Here is a list of the top five presidents that were once attorneys. Some of them you may have known were practicing law before becoming President, some not.

1. John Adams – The second President of the United States, and one of two attorneys that were also farmers at some point in their past. Adams was President from 1797-1801 after serving two terms as Vice President for George Washington. Adams became well known during the American Revolution and served as a delegate from Massachusetts in the Continental Congress.

2. Thomas Jefferson – He became President after John Adams’s term ended. He is also the second of the two attorneys to also have done farming. Aside from these professions, he was also a writer, inventor, and an architect. Jefferson is well known for being one of the main authors to pen the Declaration of Independence. He was also Secretary of State during George Washington’s first term as President, and served as John Adams’s Vice President as well.

3. Abraham Lincoln – Unlike many of the other attorneys that went on to become President, Abraham Lincoln practiced law until the very year that he decided to run for the President of the United States. Lincoln was the sixteenth president, and served from 1861-1865. He helped to make many advances in civil rights and is credited as a major factor in the abolishment of slavery in America. Lincoln was assassinated while in office by actor John Wilkes Booth who shot him in the head with a pistol inside of a theater.

4. William Taft – This man held many positions within the legal system. Not only was he a lawyer, he was also a judge, a law reporter, and the dean at the law school in the University of Cincinnati. His experience with law made him a good candidate to run for the presidency.

5. Barack Obama – Our current Commander in Chief, Obama started out as a lawyer just like the other attorneys on this list. He attended Harvard Law School, which is one of the most prestigious law schools in the world. Aside from practicing law, President Obama was also a law lecturer, community organizer, and a senator for the state of Illinois.

History has shown that being an attorney provides a good background if you someday want to become the President of the United States. For all you young ones out there that have aspirations to lead our country, you know right where to start if you want to be a contender.

While the majority of attorneys on television (save Law & Order) serve a comedic purpose while on screen, the famous film attorneys bring drama to the audiences. Some of the lawyer portrayals have been the best performances that an actor has had during their careers. Attorneys have the lives of their clients in the palm of their hand, and any mistake could directly affect the outcome in a terrible way. When this tension is captured on film, it makes for some of the best cinema available. Here are some of the top attorneys to ever grace the silver screen.

1. Atticus Finch – Portrayed by film legend Gregory Peck, Atticus left a lasting impression on anybody that has watched the movie To Kill a Mockingbird. The way that he conducted himself in a calm, yet serious manner exemplified the ‘strong silent type’ in a way that has rarely been matched by other actors playing attorneys since then, and it has been nearly fifty years.

2. Andrew Beckett – Then name of the character may not jump out at you immediately, but the movie Philadelphia had one of Tom Hanks’s best performances to date. In the film, Tom Hanks plays Andrew Beckett, a homosexual lawyer who has been diagnosed with AIDS. Beckett tries to hide his diagnosis from his fellow attorneys, but after being fired, he believes that his disease had leaked somehow and files a lawsuit. Beckett is a very memorable character, and this is a very powerful movie. Philadelphia won three academy awards when it came out in 1993.

3. Vincent Gambini – On a lighter note, Vincent Gambini, portrayed by Joe Pesci in the movie My Cousin Vinny, was one of the funniest attorneys to ever make it on screen. Released in 1992, My Cousin Vinny had several critically acclaimed performances. Marisa Tomei won the Best Supporting Actress academy award for her role as Lisa, Vinny’s girlfriend. Vincent Gambini will be remembered for years to come as a trouble-making, hilarious example of a popular lawyer.

4. Mitch McDeere – One of Tom Cruise’s better roles. Mitch was one of the attorneys in the movie The Firm. In the movie, he realizes that his law firm is representing people that are involved in organized crime, and that other people that have found this out faced some terrible repercussions. The Firm was based on a popular John Grisham novel, which may have been one of the reasons why the movie was such a huge success. The Firm made $150 million in the United States alone, and $270 million worldwide.

Many of the best dramatic performances have been portrayals of attorneys. There’s something about the courtroom setting, along with lawyers putting their lives on the line in the pursuit of justice that makes for great movies. Actors have made a career for themselves by playing these difficult roles because not all actors can pull it off. It takes a certain kind of actor to play a good attorney.

The courtroom is very frequently depicted during television shows, as well as the attorneys that make their living upholding the laws of the United States. There is a certain element of drama that comes along with the courtroom that just seems to make great television. It is almost as though you are watching a sporting event. You begin rooting for your favorite attorneys and developing a personal connection with them. Throughout the past few years, there have been many television attorneys that have made their way into popular culture, and we still remember them with fond memories of them and their sometimes wacky antics. Here are a few of the most popular attorneys from television past.

1. Ally McBeal – There is a good chance that you caught this single female lawyer on the tube during the shows stint from 1997-2002. The title character was portrayed by Calista Flockhart. The show was a huge hit when it was on, and even popularized that three dimensional dancing baby that was all the rage in the late 90′s and early 2000′s. Her and her fellow attorneys got into several strange and hilarious situations, and the character is still remembered by many.

2. Barry Zuckerkorn – Not exactly as popular as some of the other attorneys, but those that saw him remember him. Barry Zuckerkorn was an incompetent lawyer portrayed by Henry Winkler on the television program Arrested Development. The show was canceled after only three seasons even though it had received stellar reviews and six Emmy awards. It was a tragedy that the life of this show was taken away prematurely. Barry Zuckerkorn was Henry Winkler’s finest work since Happy Days.

3. Claire Huxtable – Phylicia Rashad played one of the most strong and competent attorneys in any sitcom. On The Cosby Show, Claire was a mother of five, a full time lawyer, and she had to deal with Bill Cosby’s character on a daily basis. If that does not take strength, I don’t know what does. Phylicia Rashad won two Emmy awards for her role as Claire Huxtable during The Cosby Show’s run from 1984-1992.

4. Ari Gold – All the other attorneys on this list are resting in television heaven right now, but Ari Gold (played by Jeremy Piven) is still alive and kicking. He can be seen on the HBO program Entourage where he plays the aggressive lawyer for the show’s main character, who happens to be a movie star. The show debuted in 2004, rocketing the already famous Jeremy Piven even higher in the Hollywood world for his portrayal of the always interesting Ari Gold.

There are enough television attorneys from the past and present to fill an entire stadium. These are some of the more famous and interesting ones that people are sure to remember. Hopefully the television writers out there will keep the quirky and funny lawyers coming because there’s nothing more fun to watch than somebody bumbling around while portraying one of the most important professions in existence.

All attorneys that practice law have had extensive schooling and need to an array of legal terms to be effective while in court. It is obvious that any attorneys that have stepped into a law school will be familiar with these common terms, but we all aren’t attorneys. For the general public, some legal terminology can be a bit confusing and you will not be able to follow what is going on in the courtroom if you do not have some exposure to the commonly used phrases. Here are some of the terms that are imperative for everyone to know, no matter your profession. Attorneys may be the ones to use these frequently, but it will undoubtedly be useful information whether you step into a courtroom yourself one day or you just want to watch a legal television program.

1. Objection! – This is used by attorneys during witness testimony or when evidence is submitted to the court. Objections may be raised if a litigator is badgering the witness, trying to lead the witness to state something that would incriminate them, or any other situation that may warrant it. After an objection is raised, the judge gets to make a ruling on whether the objection is ‘overruled’ or ‘sustained’. If the judge overrules the objection, then everything continues normally. If the judge says ‘sustained’, the other lawyer may have to stop their line of questioning or rephrase a question they asked the witness previously. This term is most effective when yelled angrily.

2. Docket – This is a term that attorneys must be familiar with. A docket is basically a court calendar that details which hearings and trials will be held at a particular court. Attorneys must use a docket for reference to see when they will be heading into the courtroom.

3. Court Recess – If a lawyer has a legitimate reason, they may ask for a short recess during a trial. During this time, attorneys can organize their documents or reassess their strategies if they choose to do so. A recess may also be called for by a judge or asked for by a lawyer if a plaintiff or defendant is emotionally or physically unable to continue. In these cases, the recesses may be for longer periods, and at times the trial may be continued at a different date.

4. Motion in Limine – This is used by attorneys when they want the court to decide whether a certain piece of evidence is admissible to state in front of a jury. If the judge decides that the evidence is not admissible, the evidence may not be presented to the jury. If this is decided after the evidence has already been presented, the judge will tell the jury to disregard the evidence.

You might not be able to represent somebody in the courtroom with just these terms, but you will at least be able to follow an episode of Law and Order.

From time to time, many of us get into some legal trouble. Whether the situation was unavoidable or you went out and did something stupid, you are going to have to go out and start looking for attorneys. Some of you out there may be very familiar with the judicial system and know exactly how to find the right attorneys, but for those of you that have never needed attorneys before, you need to know where to look and how to find the the right one for you. If you do not take the task of finding top attorneys seriously, you could be risking your hard earned money, your time, and even your freedom. Here are some Do’s and Don’ts for when you start your search for top attorneys in your area. Follow these rules and then stop getting into trouble.

DO: Your research when you are looking for attorneys. No matter which method you choose, whether it is the Internet, newspaper, a commercial, or anything else, just make sure you find out about who this person is. Find out where their office is, any specialties the attorneys might have, and if they are dedicated to their work. Any information that will end up helping you in the end should be found out before making any commitments.

DO NOT: Hire the first lawyer you speak with. It is important that you go around and meet with a few attorneys before making a final decision. The first one might seem great, but you could be missing out on better attorneys if you don’t look around. It is very possible that the first lawyer you spoke with might be the right choice in the end, but you should not be taking that kind of chance. If after a few meetings you still feel that the original lawyer was the best, by all means go back and hire them.

DO: Find a lawyer in your price range, but don’t be too frugal. Going into a court of law is serious no matter how big or how small the offense is. You want somebody that knows what they are doing to get in there and represent you the way that you deserve to be represented. Just don’t put yourself into debt trying to find attorneys like Johnny Cochran, their services might be a bit too steep.

DO NOT: Forget about the Internet when you are searching for lawyers. The Internet has every bit of information that your heart desires, and it needs to be utilized for your benefit. There are attorney blogs you can go to, review websites so you can see what other people think about potential litigators, and online forums. You can interact with people in the legal community or past clients of lawyers in your area when you use a forum. It is a great way to get information straight from the horse’s mouth.

Just make sure that you find someone with your best interest at heart.
